These terms apply to your use of the Living Vocally website and to any products or services you buy from us. By using the site or placing an order, you agree to them. Please read them before you buy.
1.About us
Living Vocally is the trading name of Craig Lees, a sole trader.
You can reach us at craig@livingvocally.com.
Throughout these terms, “we”, “us” and “our” refer to Living Vocally, and “you” and “your” refer to you, the visitor or customer.
2.What we offer
Through this website we provide:
- Sheet music. Original choral arrangements, sold through third-party distributors such as Sheet Music Direct and ArrangeMe. When you buy sheet music, your purchase, delivery and licence are handled by that distributor under their own terms, not ours. Our site simply links you to them.
- Director Packages. Digital audio bundles (a full demo, individual part recordings and a backing track) sold through our online store and delivered as digital downloads.
- Bespoke commissions. Custom arrangements written to order for your choir.
- Workshops, mentoring and one-to-one coaching. Booked and delivered by arrangement.
3.Orders and payment
All prices are shown in pounds sterling (GBP). Living Vocally is not VAT registered, so no VAT is charged, and the price shown is the full amount payable.
Payment is taken at the point of purchase through the payment providers built into our online store. Your order is accepted once payment has been confirmed and you have received an order confirmation. We may decline or cancel an order in the rare event of an error in pricing or availability, and will refund any payment already taken if we do.
Director Packages are for United Kingdom customers only. Our Director Packages contain recorded audio supplied under our PRS for Music licence (see section 6), which is granted on a territorial basis. For this reason the Director Packages, and any other recorded-audio products sold through our online store, are offered for sale to customers based in the United Kingdom only. By placing an order for a Director Package you confirm that you are purchasing from within the United Kingdom, and this is a condition of sale. We reserve the right to decline, cancel and refund any such order that we reasonably believe has been placed from outside the United Kingdom. Our sheet music is a separate matter: it is sold and licensed through third-party distributors under their own terms and is available worldwide. If you are based outside the United Kingdom and would like to use our recorded audio, please contact us at craig@livingvocally.com and we will help where we can.
4.Digital products and delivery
Director Packages are delivered digitally. After payment you will receive access to download your files, usually by email and through your account. Download access is available for 30 days from purchase, so please download and save your files promptly.
You are responsible for having the means to download, open and play the files, including the ability to unzip a compressed folder and play standard MP3 audio. The files are for your own use as set out in the licence below.
5.Your licence to use our arrangements and audio
When you buy an arrangement or a Director Package, you are buying a licence to use those materials within your own choir or group. You may:
- print and share the score with the singing members of your own choir, and
- use the audio to rehearse and prepare with your own singers.
You may not copy, share, sell, redistribute, publish, upload or sub-licence the materials to anyone outside your choir, whether free or for payment. Sheet music bought through a distributor is licensed separately under that distributor’s own terms.
6.Copyright and musical rights
All of our arrangements are the original creative work of Craig Antony Lees and remain his intellectual property. Buying an arrangement gives you the licence to use it as described above; it does not transfer ownership or copyright.
The underlying songs remain the property of their original writers and publishers. Where an arrangement is of an existing song:
- Sheet music is published and licensed through our distributor (such as ArrangeMe / Sheet Music Direct), who secure the necessary permissions from the copyright holders.
- Recorded audio, including the Director Packages, is covered by our PRS for Music Digital Music Services Licence, which permits the reproduction and digital supply of these works in recorded form.
7.Bespoke commissions
Bespoke commissions are agreed individually. Before work begins we will confirm the brief, the voicing, the fee and an indicative timescale in writing. Delivery times depend on current workload and will be agreed with you.
Where a commission is based on an existing song, it is subject to obtaining the necessary arrangement rights from the publisher or copyright holder, and can only be completed and supplied once those permissions are in place.
The finished arrangement is licensed to your choir on the same basis as section 5, and remains the original creative work and intellectual property of Craig Antony Lees.
8.Refunds and cancellations
Digital products. Because our digital products are supplied electronically and made available immediately, your statutory right to cancel does not apply once you have started to download or access the files, in line with UK consumer law. This does not affect your rights if a file is faulty, corrupted or not as described, in which case please contact us and we will put it right or refund you.
One-to-one coaching and private lessons. Lessons can be cancelled or rearranged with at least 24 hours’ notice. Cancellations made with less than 24 hours’ notice may be charged in full.
Workshops and events. Where you book a workshop or event, the following applies once the booking is confirmed:
- Cancellation more than 28 days before the event: no charge.
- Cancellation between 14 and 28 days before the event: 50% of the total fee is payable.
- Cancellation fewer than 14 days before the event: 100% of the total fee is payable.
If you ask to postpone an event, we will use reasonable endeavours to accommodate an alternative date. A postponement requested fewer than 14 days before the event may be treated as a cancellation at our discretion.
In the unlikely event that we are unable to deliver a booked event due to circumstances beyond our reasonable control, we will let you know as soon as we can, make reasonable efforts to provide a suitable replacement facilitator or an alternative date, and issue a full refund if neither can be arranged.
Commissions. Refund, deposit and cancellation terms for bespoke commissions are agreed with you in writing at the time of booking.
